Welcome to Flexy, (“Application”) brought to You by Flexy Corporation Limited (a company incorporated in England and Wales with registered no. 09524785 (“Us”, “We” or “Our”). We are committed to protecting the privacy of all users of the Application. In this privacy policy (“Privacy Policy”), “You” and “Your” means you, the person accessing or using the Application. 2. WHAT INFORMATION DO WE COLLECT?

2.1  We will only use any information that We collect from You in accordance with this Privacy Policy.

2.2  We will collect information that You provide to Us when You: 

(a) download the Application from an electronic marketplace;

(b) access the Application;

(c) use the Application; and

(d) contact us.

2.3 Such information includes: 

(a) Your name, company name, age, gender, website, phone number, email address, physical or mental health details; education history and qualifications; national insurance number, PAYE information, bank account details, billing and residential addresses;

(b) Your likeness by way of a photograph uploaded by You to Your Profile on the Application, and the personal details contained within your passport or work visa;

(c) Your location;

(d) information about the device You use to access the Application (“Device”);

(e) Your usage of the Application, including the: 

(i) the date and time You accessed the Application;

(ii) amount of time You spend in the Application; 

(iii) amount of time You spend on any given page within the Application; 

2.4 We may collect certain information about Your visits to Our Application and how You use it. This may include referral source, length of visit and number of page views and similar information. We may use this information for a number of purposes including Application administration, optimising the use and performance of the Application, disclosing to third party contributors or for security purposes. Individual users will not be identifiable from this information. This information may be collected by a third party analytics service provider on Our behalf and may be collected using cookies. 

2.5  Additional information which you provide voluntarily and/or which we may ask from you to better understand you and your interests.

3. HOW DO WE USE THE INFORMATION THAT YOU PROVIDE TO US?

3.1 We use Your information in the following ways:

(a) to provide recruitment services to You through the Application;

(b) contacting you with further information or in the course of providing you with Our services;

(c) to ensure that the content in the Application is presented in the most effective manner for You and Your Device;

(d) to improve the content made available via the Application; 

(e) to administer, support, improve, optimise and develop the Application; 

(f) to send You general (non-marketing) commercial communications, such as information about the Application, notification of changes to the Application and services provided to You by Us at that time;

(g) to provide You with marketing communications by electronic means (such as email, SMS and/or MMS) about Our products, services, events, which You have requested to be sent; 

(h) to provide third parties with statistical information about Our users but this information will not be able to be used to identify any individual user;

(i) to reply to any correspondence You have sent to Us; and

(a) provide You with recruitment services You have requested access via the Application, including potential and current hirers; and 

(b) to any affiliate or third party to whom disclosure is necessary to enable us to provide you with any services that you have requested through the Application which may be provided by such affiliates or third parties; 

(c) to any third party so that they can provide you with marketing communications by post and/or electronic means (such as email, SMS and/or MMS) about their own products, services, events, special discounts and offers, which you have requested to be sent, or which may be of interest to you where you have expressly consented to be contacted for such purposes;

(d) in the event that we sell or buy any business or assets, in which case we may disclose Your personal data to the prospective seller or buyer of such business or assets;

(e) if we or substantially all of Our assets are acquired by a third party, in which case personal data held by us about Our customers will be one of the transferred assets; and

(f) to any person to whom disclosure is necessary to enable us to enforce Our legal rights under this Privacy Policy or under the Application’s EULA., or to protect the rights, property or safety of Our employees or where such disclosure may be permitted or required by law (including without limitation to any court, regulator or other relevant authority).

5. THIRD PARTY WEBSITES

5.1 The Application contains content from and links to various websites. This Privacy Policy will not apply to any personal information that is collected by such websites. Please consult the terms and conditions and privacy policy of such websites to find out how they collect and use Your personal information and to establish for what purposes they may use Your personal information. 

6. HOW DO WE PROTECT YOUR INFORMATION?

6.1 We employ appropriate technological and operational security measures to protect against any unauthorised access to or any unlawful processing of any personal information about You that we hold. We will retain Your information for as long as is necessary to provide any services to You or for a reasonable period or as long as the law otherwise permits.

6.2 Data transmission over the internet is inherently insecure, and although We employ appropriate technological and organisational security measures to protect Your data from unauthorised access We cannot guarantee the security of any data sent over the internet.

Where We are entitled by applicable law to charge a fee to meet Our costs in providing You with details of the information We hold about You, We will let You know, and We may also require You to provide Us with appropriate identification before We comply with this request.

8.2 You may request that we cease sending you any marketing information at any time by notifying us in writing or following any “unsubscribe” instructions included in any marketing communications which we send to you.

8.3 We are required by UK employment law to maintain a record of your employment, your proof of right to work, earnings, and tax information for a minimum of 3-years from the end of the tax year in which it relates to. Where it is in our legitimate interest to do so, this information may be retained for longer.

9. CHANGES TO OUR PRIVACY POLICY

9.1 By accessing Our Application You consent to Our collection and use of Your personal information as described in this Privacy Policy.
